Terms of Use

Last updated

These terms are the agreement between you and Marius Kažemėkaitis, an individual trader in Lithuania who makes Detour ("we"), for the Detour app, its App Clip and the getdetour.app service. Apple's standard licence agreement continues to govern the app you download from the App Store; these terms govern the service behind it, and in particular the trips it stores for you.

1. Acceptance

By installing or using Detour you accept these terms and the Privacy Policy, which explains what we store and why. If you do not agree, do not use Detour. You must be old enough to hold an Apple Account in your country to use the service.

2. The service

Detour helps you plan multi-stop road trips. You add places on a map, and Detour calculates the routes between them on its own routing server from OpenStreetMap data, keeping to your route preferences where it can. With Detour Pro, Build me a trip composes a whole day from a start and how far you like to drive, and Detour names the trips it builds. You can share a trip as a link that others open in a browser, in the Detour app or in its App Clip, and you can export a trip as a GPX file. Each place can show its weather from Apple Weather, photos found on other sites (section 12), and a description.

Place descriptions are written by Detour with AI from public sources, and the app labels them that way. They can contain mistakes. Trips are stored on our servers under an account the app creates for you on first launch, so they can be restored after a reinstall; Sign in with Apple is optional and lets that same account follow you to a new phone. Maps come from Apple; routes are calculated from OpenStreetMap data.

We do not guarantee that a route is drivable, that a road is open, or that a place, its description or its photos are accurate or up to date. Check before you drive, and follow the road signs and the law where you are.

3. Your content

You own your trips. Everything you put into a trip, the places, the dates, the titles and the order, is yours, and nothing in these terms transfers it to us. So that we can provide the service, you grant us a hosting-only licence to store, transmit and display your trips to you and to anyone you share a trip with, and to let them make their own copy of a trip you share. The licence exists only to run the service and ends when you delete the trip or the account, except for copies others already made and the last version people following the trip already received. We do not use your trips for any other purpose. You are responsible for what you choose to share.

4. Acceptable use

You agree not to:

  • scrape, crawl or bulk-download places, routes, photos or descriptions from the service;
  • abuse the routing, search or place quotas, for example by driving the service from anything other than the Detour app;
  • reverse-engineer, bypass or replay the app attestation that protects the service, or use an account that is not yours;
  • use Detour to break the law, to share content you have no right to share, or to harm, harass or track another person.

5. Detour Pro

Some features are part of a paid subscription, Detour Pro: Build me a trip, Highlights along the route, every place worth a detour near each stop, a written description and tips for every place, and no limit on active trips. Pro comes as a yearly plan, which starts with a free trial if you are eligible for one, and a monthly plan.

Pro is sold through the App Store, and the price for your country is shown there before you buy. Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends. The subscription renews automatically for the same period unless renewal is turned off at least 24 hours before the current period ends. Manage or cancel it in the Settings app, under your name, then Subscriptions; cancel before a trial ends and you pay nothing. Billing, renewal and refunds are handled by Apple under its terms. Deleting your Detour account does not cancel a subscription.

6. Termination

You can stop at any time by deleting your account in Settings, under Account & backup, which erases your account and every trip on our servers and on the phone. We may suspend or terminate an account that breaks section 4 or that is used to attack the service, and we will tell you why where we have a way to reach you, unless the law prevents it. On termination for any reason your content is erased as described in the Privacy Policy. Before you delete the account, you can export any trip with two or more stops as a GPX file.

7. Changes to the service and to these terms

Detour is a living product and features will change. We may change or withdraw a feature, and we may change these terms. When we change them, we change the date at the top and say so on this page. If you keep using Detour after a change, the new terms apply. If you do not agree to a change, stop using Detour and delete your account.

8. Liability

Detour is provided as it is. To the extent the law allows, our total liability to you for all claims arising out of the service in any twelve-month period is limited to the total amount you have paid us for Detour in the preceding 12 months. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, for fraud, or under consumer protection rules that apply to you.

9. Weather

The weather Detour shows on a place comes from Apple Weather. It is there to help you plan, not for emergencies: follow the official warnings and instructions of the authorities where you are.

YOUR USE OF THIS REAL TIME WEATHER GUIDANCE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER DATA MAY NOT BE ACCURATE. Apple Weather Data may vary from actual conditions due to variable factors, such as signal issues and geopolitical events, that can affect the accuracy of Apple Weather Data.

10. Governing law

These terms are governed by the laws of the Republic of Lithuania. If you are a consumer in the EU, you also keep the protection of the mandatory rules of the country you live in, and you can bring a claim in its courts.

11. Contact

Questions about these terms or the service go to hello@getdetour.app, questions about your data to privacy@getdetour.app, and notices about content to notices@getdetour.app (section 13). Our postal address is Upės g. 1, Laumėnai, Kauno r., LT-53178, Lithuania, and our phone number is +370 618 83181.

12. Third-party content

The photos of a place are found through Google image search (using Serper) and on Wikimedia Commons. They are shown from the sites they were found on, with a credit that links to the page each one came from, and they are not hosted by Detour. Each photo belongs to its owner, and naming where we found it gives no one, including us, a licence to use it beyond showing it from its source.

Maps, search results and place details come from Apple, routes are calculated from OpenStreetMap data, and facts about places come from public sources such as Wikipedia. Their owners' terms apply to them.

13. Notices about content

If you believe a photo or a description Detour shows infringes your rights or is unlawful, or that a shared trip carries unlawful content, write to notices@getdetour.app. Please include:

  • your name and an email address we can reply to;
  • where the content is: the photo's address or the page it links to, the place it appears on, or the shared trip link;
  • why you believe it should be removed, and, for a photo, that you own it or act for the person who does;
  • a statement that the information in your notice is accurate and given in good faith.

We confirm that we received your notice and review it without undue delay. If we remove a photo, we remove it everywhere Detour shows it and keep that copy from coming back. If the same picture appears at another address, tell us and we remove that too. For a description or a shared trip, we decide what to change or take down. Either way, we tell you what we decided and why. You can also write to us about a description that is simply wrong.

Read also our Privacy Policy, or go back to Detour.
